NeckVille is a collection of digital artworks (NFTs) running on the Etheruem network.
This website is for informational purposes only. Users are entirely responsible for the safety and management of their own private wallets. The NeckVille contract runs on the Etheruem network and there is no ability to undo, reverse, or restore any transactions.
This website and it's connected services are provided "as is" and "as available" without warranty of any kind. By using this website you are accepting sole responsibility for any and all transactions involving NeckVille.
By visiting the website of our products merchants, in particular www.opensea.io, you also engage and agree to be bound by their terms and conditions.
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence.
You may not use our products and/or services for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
By using our website (neckville.io) and any subdomain associated with the neckville.io or our minting website (mint.neckville.com) you agree to the terms and conditions below.
Ownership
i. By connecting your Ethereum wallet to our minting website mint.neckville.com and minting an NFT from our smart contract, you have purchased a NeckVille! With this NeckVille you can show it off, use it as your pfp, sell it, and even merchandise it and sell as physical merch or use your NeckVille NFT to sell as art.
ii. Commercial Use. Subject to your continued compliance with these Terms, NeckVille grants you an unlimited, worldwide license to use, copy, and display the purchased Art for the purpose of creating derivative works based upon the Art (“Commercial Use”). Examples of such Commercial Use would e.g. be the use of the Art to produce and sell merchandise products (T-Shirts etc.) displaying copies of the Art. For the sake of clarity, nothing in this Section will be deemed to restrict you from (i) owning or operating a marketplace that permits the use and sale of NeckVille generally, provided that the marketplace cryptographically verifies each NeckVille owner’s rights to display the Art for their NeckVille to ensure that only the actual owner can display the Art; (ii) owning or operating a third party website or application that permits the inclusion, involvement, or participation of NeckVille generally, provided that the third party website or application cryptographically verifies each NeckVille owner’s rights to display the Art for their NeckVille to ensure that only the actual owner can display the Art, and provided that the Art is no longer visible once the owner of the Purchased NeckVille NFT leaves the website/application; or (iii) earning revenue from any of the foregoing.
iii. The user shall not use any NeckVilles Licensed Materials in connection with any material, which is unlawful, fraudulent, libelous, defamatory, obscene, pornographic, profane, threatening, abusive, hateful, offensive or otherwise objectionable or unreasonable or infringing upon any laws or regulations or intellectual property rights or proprietary rights or confidentiality obligations and you shall indemnify and defend NeckVille against any claims, damages, proceedings, loss or costs arising from such use. User shall not use the NeckVille Licensed Materials in any way that could be construed as being adverse or derogatory to the image of NeckVille or any of its subjects featured in the NFTs.
iii. We still have the rights to use all and any NeckVille Images from the collection for our own advertising and marketing efforts
Changes
Depending on the direction and growth of our project we have the right to change and modify our roadmap to fit current situations. We have the right to pause or place project goals on hold depending on different circumstances.
Taxes
You are responsible of any tax liability which may arise from minting or reselling your NeckVille (NFT) or any other forms of gains from NeckVille.
Not Intended as Investment
NeckVille is not an investment vehicle. NeckVille is seen as a collectible item. We make no promises or guarantees that these NFTs will be worth anything you or the market believe nor grant any right to perceive financial benefits or governance over the project. We will grow our project and do what we can to help improve our project to the best of our ability by bringing as much intangible value to the project. Please understand that the price of these NFTs have no value and should be treated as nothing more than a collectible. Note that the NFT market is highly volatile, and that your NFT may lose all value.
No Guarantees
By owning a NeckVille you agree that you are not relying on any future commitments. The only guarantee offered is that your exchange of funds for one NeckVille, you will receive one NeckVille.
Underage
NeckVille is a project aimed to people over the age of 18, or above the legal age of your jurisdiction, whichever is greater. By using this website or our minting website you agree you are of the legal age.
What you are responsible for
As a Holder, you are solely responsible for the safety of your NFTs that are attributed to your wallet, including proper management and safety, including the implementation of relevant security measures of any wallet used to store your NFTs.
Please note that the decentralized nature of distributed ledger technology (such as the Ethereum Network) makes it impossible for us to reverse, cancel, undo or otherwise alter any transaction and/or transfer. You are solely responsible for any transaction requested through your wallet.

NECKVILLE MAKES NO REPRESENTATION OR WARRANTY AS TO THE ACCURACY, RELIABILITY, TIMELINESS, OR COMPLETENESS OF ANY MATERIAL ON OR ACCESSIBLE THROUGH THE NECKVILLE PLATFORM. ANY RELIANCE ON OR USE OF SUCH MATERIALS SHALL BE AT YOUR SOLE RISK.
